THE case of an Amman Valley woman accused of causing serious injury by dangerous driving could be thrown out.
Emily Down, 28, of Parc Gwernen, Forestfach, Tycroes, appeared at Swansea Crown Court on January 24 where she was listed as entering a plea for the charge of causing serious injury by dangerous driving.
The charge relates to an incident on May 30, 2021, involving a white Citroen DS3 being driven on Penybanc Road, Ammanford.
In front of Recorder P Hobson, Ms George, defending, asked if her client could not be arraigned on the charge as they wished to request an abuse of process hearing.
Ms George cited the fact that her client was charged with drink driving, driving without a licence and failing to stop after a road accident at Llanelli Magistrates Court on July 1, 2021, – charges which she admitted.

Ms George questioned why the additional charge was being put forward now when the case was dealt with more than a year and a half ago.
Mr Simpson, prosecuting, explained there were delays in the CCTV footage becoming available and when the charge for serious injury by dangerous driving was submitted, it was initially rejected due to missing medical evidence.
It was then was accepted by the CPS on October 30, 2022, although Ms George stipulated that the CCTV was available at the time of the initial hearing and the medical evidence was relating to the fact the complainant did not sustain a fracture and instead had 15 stitches.
The CCTV - which shows the car leaving the road and hitting the complainant - was shown in court at the request of Mr Hobson.
Ms George also stated that the complainant had sold the CCTV footage to The Sun newspaper prior to the initial hearing at Llanelli Magistrates Court – where Ms Down was banned from driving for 28 months and fined £153.
Recorder P Hobson adjourned the case until March 17 and ordered the prosecution to put together a timeline of the case and reasons to counter the recommendation of an abuse of process hearing.
