A MAN accused of pointing an imitation firearm at two young children will face a retrial in December.

Tommy Addison, 18, of Nant Y Dderwen in Drefach, was on trial last week at Swansea Crown Court charged with two offences of possessing an imitation firearm with intent to cause fear of violence and two offences of making threats to kill.

It was alleged that two six-year-old children were walking past Addison’s house on March 26 when they saw him in the window pointing a gun – which turned out to be a BB gun – at them.

They immediately reported this to one of their mothers, and the police were called. Officers recovered a BB gun from the defendant’s bedside table.

Initially Addison told the police that he wasn’t at home at the time of the allegations, however he later accepted he was there, but maintained that they were “false allegations”.

David Singh, defending, said one of the children had described seeing “a bullet”, and that their description did not match the BB gun. He added that the gun was not functional, so could not have fired any pellets.

Mr Singh said the children did not give any direct evidence that there was a threat from Addison to kill them, arguing that the prosecution were asking the jury to Winfer that’s what Mr Addison meant”.

The jury found Addison not guilty of making threats to kill, but were unable to reach a decision on the remaining charges.

Judge Geraint Walters discharged the jury, and gave the Crown Prosecution Service time to consider whether they sought a retrial on the imitation firearm offences.

Regan Walters, standing in for trial counsel Georgia Donohue, confirmed that a retrial would be sought.

This was listed for December 18. Judge Catherine Richards remanded Addison back in to custody until that date.
